you agree to be bound by the following Terms and Conditions:
1. By submitting
an item for auction, catalog sales or solicited by reverse auction,
the seller agrees to pay www.BeautyPortal.net
and Nathalie Publishing Corp. a non-refundable commission based on
the selling price and the (commission
table), unless www.BeautyPortal.net
and Nathalie Publishing Corp. have agreed to a different compensation
provision prior to the item being submitted for auction solicited
by reverse auction and catalogue sales. www.BeautyPortal.net
and Nathalie Publishing Corp. reserve the right to add, delete or
change any of our services or rates at any time without notice. |
| 2.
By submitting an item for auction catalogue sales or acknowledging
participation in a reverse auction, the seller represents and warrants
its intention and ability to sell that item. This includes a representation
that the seller has legal title and the present ability to transfer
legal title to that item. Selling illegal items is strictly prohibited
and www.BeautyPortal.net and
Nathalie Publishing Corp. reserve the right to withdraw from the marketplace
any item that www.BeautyPortal.net
and Nathalie Publishing Corp. believe, in our sole discretion, to
be inappropriate, offensive, or objectionable. |
| 3.

Publishing Corp. specifically prohibit the sale of pornographic material,
including, but is not limited to, pornographic books, magazines, and
videos. www.BeautyPortal.net
and Nathalie Publishing Corp. reserve the right, in their sole discretion,
to refuse to post merchandise for sale from anyone at any time. |
| 4.
The seller is prohibited from manipulating the price of any item submitted
for auction to www.BeautyPortal.net
and Nathalie Publishing Corp., either by placing bids themselves or
using a third party to place a bid (a "shill"). Sellers who bid on
their own merchandise more than once or use a shill will be barred
from selling merchandise in the future. |
| 5.
The seller assumes all risks and liability arising from their offer
for sale of any item. This includes, but is not limited to, the risk
of a buyer failing to pay for the merchandise and freight damage or
loss of merchandise in transit. By submitting an item to www.BeautyPortal.net
Marketplace, you are agreeing to hold www.BeautyPortal.net
and Nathalie Publishing Corp. harmless from any liability arising
out of the offer for sale of any item, the sale of the item or any
risk of loss or non-payment. |
| 6.
www.BeautyPortal.net and Nathalie
Publishing Corp. reserve the right to move items from one category
to another as we deem appropriate. We may move items when categories
become crowded so as to better present and organize your merchandise
for the benefit of bidders. |
| 7.
www.BeautyPortal.net and Nathalie
Publishing Corp. do not provide winning nor reserve bidder information
to sellers, this information is to be considered private and confidential
by the seller. Abusing private user information is strictly prohibited,
including, but not limited to, telephoning, mailing, and emailing
other bidders or sellers, except as necessary to complete a transaction
or unless such contact is solicited by the other party. |
| 8.
We retain all unsuccessful bids for each item. In the event of a problem
with the initial winning bid, www.BeautyPortal.net
and Nathalie Publishing Corp. reserve the right to declare the next
highest bidder the winner provided that their bid meets or exceeds
the seller's reserve price, if any. In the event of an incomplete
auction or fixed-price transaction, www.BeautyPortal.net
and Nathalie Publishing Corp. reserve the right to charge the seller
a non-refundable commission fee based on selling price or minimum
bid price, whichever is higher. If www.BeautyPortal.net
and Nathalie Publishing Corp. determine, in their sole discretion,
that the seller has caused incomplete auction. |
| 9.
The seller shall be solely responsible for the collection and remittance
of sales and other applicable taxes, fees, excises or duties, if any,
related to the sale or purchase of any items, and hereby agrees to
indemnify, defend and hold www.BeautyPortal.net
and Nathalie Publishing Corp. and its affiliates harmless from any
liability, loss, claim (including, without limitation, any tax claim
or assessment of any kind) and expense (including attorneys' fees)
related to failure of seller to collect or pay any taxes or fees which
seller is obligated to collect or pay or to obtain any licenses, permits,
or other approvals which it is obligated to obtain. |

All other rules stated in the Bidding Rules section apply to sellers
as well as buyers. |

OR IMPLIED WARRANTIES, REPRESENTATIONS OR CONDITIONS OF MERCHANTABILITY,
OR FITNESS FOR A PARTICULAR PURPOSE. |
